Has your employer informed you that they intend to abandon a patent covering your invention?

What is behind this step and how can we support you in this situation?

What it is

According to the German Act on Employee Inventors, your employer often has to inform you before abandoning a patent protecting an employee invention notified by you.

Within a period of 3 months as of the date of receipt of such a notice, you are entitled to ask for a transfer of the patent.

However, you have to bear the costs for the transfer and the future maintenance of the patent.

These often-significant costs, as well as the uncertain prospect of a successful use or commercialization of the patent, discourages many inventors like yourself from making use of their right to ask for a transfer of the patent.

The result of this is that numerous patents expire before completing the maximum legal lifespan and that's a HUGE missed opportunity for all of that hard work.

Our Motivation

The US economy grows when there is new innovation and progress. German employees’ inventions contribute greatly to this goal of growth.

However, commercializing products absolutely requires protection through patents by the United States Patent & Trademark Office.

We strive to avoid that legal protection for a valuable invention expires for the only reason that an employee, after being informed about his employer’s intention to abandon, cannot afford the transfer of the patent.

How we can help you...

If you should find yourself in such a situation, please contact us.

We will analyze your patent based on internal criteria.

Nothing will stand in the way of a mutually advantageous cooperation if it proves itself valuable and marketable.

We will take over the costs for the transfer and future maintenance of the patent and we will take care of its commercialization.

The profit generated from working together can be attained without you having to put up any cash up-front. We are open to all types of deal structures including revenue splitting and even full purchase.
